What “family cascade” means when an H-1B is laid off

Most layoff guidance focuses on the H-1B principal: 60 days of grace, transfer paths, B-2 conversion. But every dependent in the household is on a derivative status that cascades the moment the principal’s status changes. This tool surfaces the timing that matters.

  • H-4 / L-2 spousesshare your 60-day grace window only as long as you remain in the US to use it. If you depart on Day 30, the spouse’s status ends on Day 30, not Day 60.
  • H-4 / L-2 EAD is tied to your I-94. The card itself may show an expiration date months away — but functionally the work-authorization ends when your status ends.
  • Children age out at 21. For India- and China-born families with backlogged green-card categories, the math gets non-obvious. The CSPA (Child Status Protection Act) can subtract I-140 pending time from a child’s age, but only after the I-485 is filed.
  • F-1 fallback for aging-out kids is the standard playbook — get an I-20 from a SEVP-certified school 3–6 months before the 21st birthday, file I-539 change of status. Even community-college I-20s work.
