Compelling Circumstances EAD

1-year work authorization for principal beneficiaries of approved I-140s facing compelling circumstances. Heavily under-used.

8 CFR 204.5(p). Filed on Form I-765 with category code C(35). Requires: approved I-140 + compelling circumstances (serious medical condition, employer dispute, retaliation, school enrollment disruption for school-age children, significant financial loss). Note: an EAD authorizes WORK but does not maintain H-1B STATUS — many use it as a bridge while pursuing a future H-1B transfer. Renewable in 1-year increments while compelling circumstances persist. One of the most under-used protections in the system.
